Medicare Advantage Plans and HMO Litigation: HMOs sell healthcare plans called "Medicare Advantage Plans" to Medicare beneficiaries, who are either elderly or disabled. Although the plans offer supposed benefits that original Medicare does not have, Medicare Advantage Plans require the enrollee to join a private network of healthcare providers. In other words, when a beneficiary enrolls in a Medicare Advantage Plan, they can no longer use their regular doctor in many cases. Their normal healthcare coverage is substantially changed. These important facts are not disclosed to the enrollee at the time of enrollment. Enrollees often incur excessive medical bills if they go to a doctor or medical provider outside of the HMO network.
